In certain instances, a public agency and property owner are not able to reach a negotiated settlement in connection with the proposed acquisition of the property for a public use. In such cases, the public agency has to consider the adoption of a resolution of necessity authorizing the filing of a complaint in eminent domain to proceed with the project.
