Overview
Validation actions allow a public agency or an interested private party to determine the validity of specified public agency actions. These lawsuits are used to eliminate uncertainty and confirm the legality of actions such as a local agency’s issuance of bonds or the formation of certain special districts. They are a powerful tool, because judgments in validation actions cut off future challenges to the legality of the matter that has been validated. But, they also come with special set of procedural requirements that can pose a challenge.
RWG’s attorneys have broad experience obtaining favorable judgments in these matters and defending against challenges to public agency actions (sometimes called “reverse validation actions”). We have handled numerous validation actions related to complex public finance transactions, other forms of public indebtedness, and a Property Assessed Clean Energy (PACE) program, thereby providing certainty for local agencies in connection with these matters.
Regardless of the size or scope of the underlying transaction or decision, RWG’s attorneys have the specialized legal knowledge and practical experience to successfully handle validation actions for all types of matters.
